Agapanthus S.r.l. guarantees it respects the General Data Protection Regulations’ principles (GDPR) and informs the user that personal data provided by the parties through the various collection channels, directly or indirectly managed by the Data Controller, or acquired from third parties in accordance with the conditions indicated by law, will be lawfully and fairly processed, in accordance with the GDPR’s principles.
NATURE AND TYPES OF PERSONAL DATA
The visit and consultation of the Site does not imply any collection nor processing of any user’s personal data.
The processing of personal data of the users who visit and consult the Site is limited to the so-called surfing data, i.e. the data whose transmission to the Site is implicit and necessary for the performance of the informatic system in charge that manages the Site and for the use of the internet’s communication protocols. Surfing data are, for example, the IP addresses or the domain names of the computers used by the users who connect to the Site and other parameters relating to the type and the operating system used by the user. Surfing data are collected and processed by Agapanthus S.r.l. exclusively for statistical purposes and in an anonymous way in relation to the access and use of the Site and for the purpose of verifying the correct performance of the Site and of improvement of the performance of the Site and of its content. Surfing data are deleted immediately after they are processed in an anonymous form; such data may be used for the purpose of assessing possible responsibilities in case of internet crimes committed against the Site or through the Site. Agapanthus S.r.l., except for the aforementioned circumstances, keeps the users’ surfing data only temporarily for a maximum period of seven days or for the period of time required by law.
Furthermore, Agapanthus S.r.l. collects and processes personal data that the user voluntarily provides or that it collects, also by third parties, during its activity. Personal data may be voluntarily provided by the user by using the Site or by requesting any of the services offered through the Site, for example upon user’s subscription to the Site or to any other initiatives offered through the Site, upon user’s request to Agapanthus S.r.l. of information or informative material or when the user sends to Agapanthus S.r.l. any communication by email or through the Site. Agapanthus S.r.l. will also process user’s personal data in order to assess or defend itself in legal claims and to comply with laws, regulations and Community legislation, as the case may be.
Upon the user’s consent, that is free and optional, Agapanthus S.r.l. may also process the user’s personal data for the purpose of defining individual and/or group profiles (profiling), and for marketing purposes, and may use them in order to send to the user – through newsletters, e-mails, sms and mms – information and updates on its products, offers, exclusive sales, promotional campaigns and on events and similar initiatives organized by Agapanthus S.r.l. or to which Agapanthus S.r.l. takes part, including invitations to such events. User will always have the opportunity to oppose itself to the processing of his/her personal data for such promotional purposes by sending an e-mail to Agapanthus S.r.l.; in each communication there will be a specific section in which the terms for revoking the consent are specified. In such event the user will no longer receive any promotional material and information. It is understood that the profiling activities will not be performed with information relating to user’s purchase of products of Agapanthus S.r.l. through the Site www.agapanthusgioielli.it.
As per the indicated data processing, the Controller may know some particular kind of personal data, and in particular the Log File of the internet navigation. The use of such a kind of data is made in accordance with Article 9 of the GDPR
AIMS OF TREATMENT
The processing of personal data and phone and/or email contact details is necessary to carry out user’s requests that could include offers targeted on their personal interests and communications related to specific requests received from the client.
Agapanthus S.r.l. needs to collect data, not being otherwise able to process data.
Any improper or insufficient communication of the required data will imply the total or partial impossibility of carrying out the user’s requests and may prevent Agapanthus S.r.l. from the proper performance of the agreement between the parties and or the law.
In particular, the use of personal data will be finalized to the provision of services to users / visitors / customers.
Personal data, upon user’s specific consent, can also be processed for the purpose of knowing interests and habits of customers, the customer satisfaction and for sending commercial information or advertising material, for direct marketing campaigns, for the customer’s care services, market researches and other operations directly or indirectly related to marketing activities.
The supplying of these data, however, is not mandatory. The possible refusal or revocation of consent to data processing does not affect the establishment / continuation of the relationship.
MODALITIES OF DATA PROCESSING
Each data processing is carried out in compliance with articles. 6, 32 of the GDPR and the proper security measures.
DATA COMMUNICATION, DIFFUSION AND PROFILING
User’s personal data will be accessible by the internal and external employees and consultants of Agapanthus S.r.l. that need to know them because of their duties. The complete and updated list of processors and of the subjects to which data may be communicated will remain at user’s disposal and the user can request Agapanthus S.r.l. to tell him/her who such persons are.
User’s personal data may be communicated to professionals, independent consultants third parties to which Agapanthus S.r.l. may revert to for the performance of technical and organizational services for the purposes above reported and to the persons allowed by laws or regulations.
The aforementioned subjects that may receive user’s personal data will process them as Controllers, processors or persons in charge of processing, as the case may be, for the same purposes above specified and according to applicable data protection law; they are provided only with the information necessary to the relevant functions. user’s personal data will not be communicated to third parties nor will be subject to any automated decision-making procedure, including profiling.
PROVIDING OF PERSONAL DATA
Providing of personal data by the user is necessary for the performance of the services offered by the Site and/or required by the user by, for example, the subscription to the Site or by the use of other services offered through the Site and for replying to user’s questions or sending information and informative material requested by the user. Providing of personal data by the user is necessary to assess and defend legal claims and to comply with the current legislation; the user’s deny to provide his/her personal data in the above mentioned circumstances would prevent the user from subscribing himself to the Site or to other initiatives offered through the Site, from receiving services, replies to his requests, information and informative material from Agapanthus S.r.l..

The user who has signed up, giving his consent, to the Agapanthus S.r.l.’s newsletter will receive, every month, an email with the following content:
• information and invitations to events organized by Agapanthus S.r.l. or in which Agapanthus S.r.l. is involved;
• information on the timing and methods of participation to promotional activities and/ or Customer fidelity programs Agapanthus S.r.l. organizes.
The subscription is done through a popup mask that appears on this website or filling out a special form.
The newsletter is managed through MailChimp, the user’s email address is stored on the MailChimp servers (that may be outside the European territory) and, periodically, on the backups Agapanthus S.r.l.. makes.
MailChimp provides Agapanthus S.r.l. with information on who opens the newsletter and click on the links. This information is used by Agapanthus S.r.l. only for statistical purposes and to evaluate the profitability of certain promotional activities.
The user who no longer wishes to receive the newsletter can, at any time, cancel his subscription through the link at the bottom of each message.
After unsubscription, MailChimp still maintains the data of the ex-subscribers to avoid being able to force their reintegration into the mailing list. The definitive and immediate cancellation of user’s data can be arranged manually upon written request by the user.
USE OF THE CONTACT FORM
The user can communicate to Agapanthus S.r.l. through the “Contact” form on this Site. The data collected in this way are used by Agapanthus S.r.l. only for the purpose of replying to the user. The same applies if the user contacts Agapanthus S.r.l. by e-mail. Such data are stored in the email archive and in the backups; Agapanthus S.r.l. is the Data Controller, is responsible for the data processing and does not transfer them to third parties unless authorized by the user.
PERIOD OF STORAGE
According to art. 5 of the GDPR and in compliance with the data minimization’s principle data will be kept for a period of time not exceeding the achievement of the purposes which are the reason why they were collected and processed for the execution of the contract or the related services and in compliance with law’s principles.
Personal data collected for profiling or marketing purposes are kept, according to law, respectively for a period not exceeding twelve or twenty-four months beginning from their registration.
USER’S RIGHTS AND UPDATE
The user is, at any time, entitled to exercise his/her rights as provided by articles 15, 16, 17, 18, 19, 20, 21, 22 of the GDPR, included the right to obtain information about the existence of his/her personal data, to verify their content, origin and accuracy, to ask for their integration, updating, amendment, erasure, portability. Should he/she has legitimate reasons, the user may also oppose himself/herself to such use.

Our jewels are handmade and hand fine finished, so each jewel is unique and can be slightly different from the other.
The gold used by Agapanthus is almost always brushed by hand. However, when the jewelry is polished the wording used is “shiny gold”.
The stones, which are precious or semi-precious, are natural and carefully chosen for cut and color: for this reason they may be slightly different from those photographed.
Our efforts are aimed to represent Products in the most accurate manner by the use of photographs and other images provided on the Site.
However, some jewels may appear slightly larger or smaller than their actual size due to screen defects or photographic techniques.
Other items may be represented on a larger scale than the actual size so to highlight all the details, or scaled to show the object in its entirety. Moreover, the details displayed on the screen (such as colors, patterns, textures, etc.) depends on the characteristics of the device used, and therefore may not accurately reflect the actual properties of the Products that will be delivered.
The availability of ring sizes is always specified.

The contract between the parties (hereinafter the “Contract”) is executed when the Shipping email is sent, which constitutes confirmation and acceptance of your Order. With the Shipping email (and confirmation of the Order picking), you will receive the shipment number “tracking number” for the shipment tracking and you will receive the invoice if requested.
The Contract only concerns the Product(s) whose shipment has been confirmed by sending the Shipping email.
Please check if you receive both the Confirmation email and the Shipping email also among the Junk emails and check the data summarized therein. Please let us know immediately if there are any mistakes.
Our prices are quoted in Euros and include VAT.
Shipping costs with courier are included in the price for shipments in Italy but are nevertheless specifically indicated.
For all Countries other than Italy, which are part of or outside the EU area, shipping costs and any additional charges (such as customs duties and taxes) will be calculated from time to time and communicated to the buyer before purchase is concluded.
The prices and shipping costs may be subject to change at any time, except for Orders already confirmed by the Shipping Email.
The Order of purchase and shipping will be effective once the successful outcome of the payment is verified.
Payment can be made by using PayPal or one of the following credit cards: Visa, Mastercard, Amexco and Diner’s or by bank transfer to the coordinates that we will send you in case you chose this last payment method.
With regard to credit card payments, the credit card holders may be subject to authorization and authentication. We are not responsible for any delay or non-delivery of (the) Item(s) you ordered, if the issuer of your credit card or our service providers refuse or do not authorize or validate the payment for any reason.
Product Delivery will take place at the address you specify in the Order.
The time of delivery may vary depending on the type of Jewel ordered, normally it takes two weeks.
You will receive a confirmation of the estimated time of delivery when your Order will be accepted.
For purchases made during the periods between 1 August and 20 August and between 25 December and 6 January of each year, delivery times may be subject to variation as a result of the closure of the goldsmith’s workshops.
The property and the risks related to (the) Item(s) pass to you upon delivery.
Upon delivery you have to inspect the Item (s) in order to check for any defects or damage. Should you discover any defects or damage, you will have to immediately complaint to the courier upon delivery and to notify us immediately by email to: email@example.com.
The complaint must take place within two months from the date when you discover any damage or defect.
Only if it is found that the damage of (the) Item (s) has occurred before delivery, or that the defect is not due to your fault or use, we will provide to its repair or replacement or you will receive the full refund of the price you paid, including any shipping charges incurred by you to receive (the) Product (s), unless the damage does result from the wearing or use of the Product (s). If you prefer the repair or replacement of (the) Item (s), please contact us.
In case of lack of conformity of (the) Product (s) in accordance with Article 129 of the Italian Consumer Code, it will be applicable the legal guarantees provided for in Articles 129 et seq. of the Consumer Code. You will have the right to have, without any charge, the conformity restored by repair or replacement. In case of impossibility of the remedies above, you are entitled to an appropriate reduction of the price of Products, or to terminate the Contract. These rights are considered waived if any lack of conformity is not notified to us within two months from the date on which it was discovered.
Our responsibility extends to any lack of conformity that you may discover within two years from delivery. In any case, the right to introduce proceedings in order to verify the presence of any lack of conformity, if not willfully concealed from us, automatically cease after twenty-six months from delivery.
Please note the following for good maintenance and proper care of jewelery:
– taking care of the jewel: our jewels should be washed with Marseille soap and dried with a soft cloth – our jewels are brushed or polished by hand and the use over time causes a loss of the original finish that can be restored by brushing or polishing the jewels again.
– It is advisable to be careful in the use of perfumes and detergents with jewels with stones and / or pearls
Our Jewels are shipped in their original box, which is then inserted into a padded box and is entrusted to a specialized courier to preserve, as far as possible, the integrity of the Product.
We are not responsible for any delayed or omitted performance of our services if this is due to cause we are not responsible for.
Likewise, we are not responsible for any delays, defects or failure to fulfill the obligations specified herein, in the event of force majeure and circumstances reasonably beyond our control. We shall not be responsible, except in cases of willful misconduct or gross negligence, for outages or malfunctions related to the use of the Internet outside of our control.
We are not responsible for damages, losses and costs you incur as a result of non-performance of the Contract for causes beyond our control.
We are not responsible for any fraudulent or illegal use of credit cards that may be made by third parties upon payment of the purchased Product (s).
The right to cancel the Contract can be exercised within 14 days – Cooling Off Period – beginning on the day you receive the Product, by notifying the Vendor by registered letter with return receipt addressed to: Agapanthus SrlSrl Via Cavour 14, 23900 Lecco (LC) Italy.
The registered letter can be anticipated by email to firstname.lastname@example.org but in any case, the withdrawal must be confirmed by sending the registered letter as above indicated.
The Jewel in its original packaging (including packaging and certificates) shall be immediately shipped, by courier or insured postage pack, at the purchaser’s expense, to Agapanthus S.r.l. (at the address above indicated) within 14 days from the day you receive the Product (the bulletin courier or the postal forwarding stamp will be faithful). It will not be possible to ship COD, or with freight collect.
You must observe due diligence in the care of (the) Item (s) in your possession. In case of default, we reserve the right to deduct the cost of any deterioration of (the) Product (s), up to the cost, from the amount that would otherwise has to be reimbursed to you.
The Puchaser will provide his bank detaild so that Agapanthus Gioielli can re-credit the amount paid for the Product (s) by wire transfer. The bank transfer will be arranged as soon as Agapanthus Gioielli has received the Jewel (and has verified the good state of preservation) and in any case within 14 days from the moment in which Agapanthus will know the canceling of the Contract.
They can not be returned Products in the cases referred to in Article 59 of the Italian Consumer Code, such as specially customized Products, carved or individualized, etc…
In the event that the Product is returned according to the terms indicated, we will refund the entire Product price (except any deductions due to the use or to the damage of the Product) as well as the standard shipping costs paid when purchasing.
The refund will be made within 14 days, respectively:
– from the date of our email confirming that your order was canceled; or
– if the Products have been delivered to you, from the date we receive the Product back or, if earlier, from the date in which you prove that you have sent the Product back to us.
If the Product has not been shipped to the shipping address you have indicated, the refund will be made within 30 days from the date in which the Contract is canceled.
In the future it may no longer be possible to read these Terms of Sale or your Order details; we therefore recommend you to print a copy for your next consultation.
These Terms of Sale and any other document expressly mentioned herein constitute the entire agreement between the parties with reference to the Contract.
The Contract and any further communication between the parties will be written in Italian.
Any disputes concerning the interpretation, validity or enforcement of these Terms and Conditions shall be referred to the exclusive jurisdiction of the competent court at the place of residence or domicile of the consumer.
The invalidity or unenforceability ascertained before the courts of one or more provisions of these Conditions of Use or Sale shall not affect the validity and enforceability of any remaining provisions.
No delay or failure to exercise powers, rights or remedies granted under these Terms of Sale will be worth as waiver thereof, nor the partial exercise of such powers, rights or remedies will prevent further exercise thereof in the future.
Any communications to us shall be made in writing to the address indicated in these Terms of Sale. Any communications to you shall be made to the email address or to the postal address you provided in the Order or you used to submit the Order.
